Terms & Conditions of Sale & Service

These Terms and Conditions apply to all quotes, orders, proposals, and transactions with Any Steel Services Pty Ltd (ABN 19 081 841 830), trading as Any Type Trucks, and any other related entities or business names under its control ("Any Type Trucks", "we", "us", "our"). By accepting a quotation, placing an order, or otherwise engaging our products or services, the customer (“you”, “your”) agrees to be bound by these Terms in full.

1. DEFINITIONS

Agreement refers to the complete understanding between Any Type Trucks and the Customer, comprising these Terms, our Quotation (if issued), and any related Order Acknowledgement.
Goods means the vehicles, truck bodies, fabricated equipment, accessories, or services we agree to supply.
Quotation means the written offer provided by us for the supply of Goods.
PPSA means the Personal Property Securities Act 2009 (Cth).
ACL refers to the Australian Consumer Law under the Competition and Consumer Act 2010 (Cth).

2. QUOTATIONS & ORDERS

A quotation is valid for 30 days unless otherwise stated.
A quotation is not an offer to sell. No binding contract exists until we have accepted your purchase order in writing.
Acceptance is subject to availability of materials and confirmation of specifications.
You must ensure all specifications, optional inclusions, and upgrade details are correct prior to confirmation.

3. PRICING & PAYMENT

Prices exclude GST and other applicable taxes unless stated.
A deposit (typically 10%) is payable to secure pricing and commence production.
Full payment must be made before delivery, unless otherwise agreed in writing.
Title does not transfer until all amounts owing to us are received in cleared funds.
If payment is overdue, we reserve the right to charge interest at the Westpac Indicator Lending Rate + 4% per annum.
You may not withhold or offset payments under any circumstances without prior written agreement.

4. CANCELLATION & VARIATIONS

Orders may not be cancelled without our prior written consent.
If cancellation is accepted, you will be liable for:

all costs incurred to the date of cancellation, including materials, labour, and supplier charges; and
a restocking fee or liquidated damages equivalent to 10% of the order value (minimum).

Variations requested by you must be in writing and confirmed by us. We may revise pricing and delivery accordingly.

5. DELIVERY

Delivery dates are estimates only. We are not liable for delays beyond our control.
Risk in the Goods passes to you on delivery or collection.
Delivery is deemed complete when the Goods are made available at our site or delivered to your nominated address.
Storage fees may apply for delayed collection beyond 7 days after notification of readiness.

6. TITLE & PPSA SECURITY

Title in the Goods remains with us until full payment is received.
Until title passes:

You hold the Goods as bailee;
You must not sell, dispose of, or encumber the Goods;
You must insure the Goods at full value; and
You hold any sale proceeds on trust for us.

We reserve the right to register a security interest in the Goods under the PPSA and you waive the right to receive any PPSA notice (to the extent permitted by law).

7. RESPONSIBILITY FOR GOODS

We are responsible for supplying Goods that meet the specifications agreed in writing.
We are not responsible for any damage or fault caused by third-party installation, misuse, neglect, or use outside intended purpose unless expressly stated.

8. LIMITATION OF LIABILITY & PRODUCT RESPONSIBILITY

To the extent permitted by law, Any Type Trucks does not represent that the Goods are fit for any specific purpose unless expressly agreed in writing. You are solely responsible for ensuring the suitability of the Goods for your intended application.
We are responsible for delivering Goods that are free from material defects in workmanship under normal use, for the period stated in the Quotation or supporting documentation.
Our responsibility does not extend to failures, damage or loss caused by:

Misuse, incorrect installation, neglect, or unauthorised modifications
Wear and tear, corrosion, rust, weather exposure, or UV damage
Use outside of design specifications, load ratings, or approved vehicle applications
Third-party components or accessories not supplied or installed by Any Type Trucks

Where we are found liable for defective Goods, our obligation is limited (at our discretion) to:

Repairing or replacing the affected component; or
Refunding the value attributable to the defective part.

Unless otherwise agreed in writing, the Customer is responsible for returning the Goods to our premises for assessment, and covering the cost of removal, transport, and reinstallation.
Under no circumstances will Any Type Trucks be liable for indirect, special, or consequential losses including, but not limited to, downtime, lost income, business interruption, or reputational harm.
These terms do not exclude or restrict any rights you may have under the Australian Consumer Law, where such rights cannot be excluded.

Important: Any warranty provided by Any Type Trucks — whether standard or project-specific — is only valid if issued or approved in writing by the Managing Director in accordance with the company’s Warranty Policy. No other party is authorised to make warranty commitments, assurances, or variations.

Project-specific warranty modifications or extensions must be documented via a Warranty Addendum approved by the Managing Director. If no such Addendum is issued, only the standard ATT Warranty applies.

9. PROPRIETARY INFORMATION

All proprietary materials, including but not limited to CAD drawings, designs, technical specifications, custom configurations, documentation, component layouts, and branding remain the exclusive intellectual property of Any Type Trucks unless otherwise agreed in writing.
Any custom design or engineering work performed remains the property of Any Type Trucks, including modifications, enhancements, or derivatives, whether developed independently or at the request of the Customer.
The Customer must not, and must ensure that others do not, replicate, reverse-engineer, distribute, or otherwise make commercial use of Any Type Trucks’ intellectual property without prior written consent.
Any documentation, training materials, processes, or build methods shared with the Customer are considered confidential and must not be disclosed or shared without authorisation.

10. FORCE MAJEURE

We are not responsible for failure or delay in performance due to events beyond our reasonable control including, but not limited to, acts of God, natural disasters, strikes, pandemics, supply chain disruptions, government actions, or transport delays.

11. CONFIDENTIALITY

All specifications, quotes, designs, and communications shared with you are confidential and may not be disclosed to third parties or used to reverse-engineer products unless authorised in writing.

12. GOVERNING LAW & JURISDICTION

These Terms are governed by the laws of Queensland, Australia. You agree to submit to the non-exclusive jurisdiction of the courts in Queensland for any dispute.

13. ACCEPTANCE

By signing a quote, issuing a purchase order, or otherwise confirming an order, you agree to be bound by these Terms in full.

14. JOINT AND SEVERAL LIABILITY

Where more than one party is named as the Customer under this Agreement, each of those parties is jointly and severally liable for all obligations and liabilities arising under or in connection with the Agreement. This means we may seek performance or payment in full from any one of them, at our discretion, without having to claim proportionately.

15. NO RELATIONSHIP

Nothing in this Agreement creates a partnership, joint venture, employment relationship, agency, or fiduciary relationship between Any Type Trucks and the Customer. Neither party has the authority to bind or represent the other in any way unless expressly stated in writing.

16. CUSTOMER-SUPPLIED VEHICLES

Where the Customer supplies a vehicle, chassis, or other equipment to Any Type Trucks for modification, installation, fabrication, or inspection, the Customer acknowledges that the vehicle is provided at their own risk.
We will take all reasonable care to safeguard your vehicle while it is in our custody. However, we do not accept liability for loss, theft, damage, or degradation caused by third-party acts, environmental exposure, acts of God, or pre-existing conditions in the vehicle.
Any claims related to physical condition, damage, or operational performance must be reported upon return of the vehicle and may only relate to issues directly and demonstrably caused by Any Type Trucks’ work or handling. We are not responsible for unrelated mechanical issues, faults, or cosmetic concerns that pre-date our involvement or that arise outside our scope of work.
Note: Due to limited workshop capacity, we cannot guarantee undercover or locked storage for customer vehicles or equipment. Unless otherwise arranged, all vehicles will be stored outdoors in our secure yard when not actively under production.

17. SEVERABILITY

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that part will be severed from the rest of the agreement. The remaining provisions will continue to operate as if the invalid section had not been included, unless doing so would materially change the intention of the parties.

18. ONLINE & CARD PAYMENTS

By submitting a payment online or via credit card, you confirm that you are authorised to use the payment method provided and approve the transaction amount.
A surcharge may apply to credit card transactions. If applicable, the amount and rate of the surcharge will be disclosed at the time of payment.
Refunds for payments made by credit card or online will only be issued in accordance with these Terms & Conditions. Chargebacks or payment disputes lodged without first contacting Any Type Trucks may delay resolution.
All credit card payments are securely processed through third-party payment gateways. Any Type Trucks does not store your card details.
By proceeding with payment, you acknowledge and agree to these Terms & Conditions in full.

🔒 Warranty Governance Clause

Director of Any Type Trucks. No other party is authorised to commit to warranty variations.
